USER CONSENT

By accessing and using the Website, users expressly agree to the Terms of Usage and should read them carefully before using or registering. Continued use signifies acceptance of the terms and legal binding, regardless of changes made to the Website.

GENERAL DESCRIPTION

The astrological content, reports, data, consultations and other services offered by our website are based on an Internet portal. There are also free services present for all the users. Those users who want personalised services should register themselves on the website. The user agrees to provide complete and accurate information by registering themselves for paid services.

REGISTRATION AND ELIGIBILITY

1. The user should not be a minor, i.e. below 18 years of age. A minor cannot use any services without a legal guardian. The user should provide accurate and current information. The account will be suspended or terminated if the information provided is inaccurate or incomplete.

We allow users to contact our astrologer via telecommunication through our “Call with Astrologer” service. Users give their consent to our website to arrange a call with our astrologer on their mobile number by agreeing to our terms and conditions.

WEBSITE CONTENT

1. The website and external hyperlinks are private property. All interactions, including those with the Licensed Provider, must adhere to these Terms of Usage. Users are prohibited from posting or transmitting material that violates others’ rights, is unlawful, abusive, defamatory, or objectionable, encourages criminal behaviour, or violates any law. This includes any material that could constitute a criminal offence or civil liability.
2. The website reserves the right to suspend or terminate user access or registration, and to change or discontinue any aspect or feature of the site, including content, graphics, deals, offers, and settings. The website also advises that any information not provided by the third-party service provider, educational materials, or incidental information should not be considered medical advice.
3. We do not guarantee any medical advice from any third party. Users should consult a doctor in case of any treatment or diagnosis. We don’t guarantee any safety or effectiveness of medicine or treatment.
4. The users should access the website at their own risk. Any legal remedy or liability for actions of service providers should be limited to the party causing harm. There should be no attempt to seek legal remedies from the website.

USER ACCOUNT ACCESS

3. The Service Provider, including the Astrologer, acknowledges that their relationship with the Website is limited to membership and acting solely for their own benefit. The Website reserves the right to terminate or deactivate its profile for any violation of usage terms and Service Terms and Conditions.

DELIVERY, CANCELLATION AND REFUND

1. The website is not responsible for refunds on orders that have reached the “processing” stage, as the risk and liability for placing hasty orders lies with the user, and the website is not liable for any refunds.
2. Orders cannot be refunded once they are placed and executed. However, if a user wishes to cancel an order before execution, they must contact the customer care team within one hour, and the refund is at the website’s discretion.
3. If there are any delays due to technical problems on the website during any reports or requests, there will be no refunds made for this. The user is advised to check everything before making any progress.
4. There will be no refunds for issues due to incorrect information provided by the user. The user can request or contact our customer care for changes within an hour of service execution.
5. The user agrees to be fully responsible for any damage caused to the product after delivery, and for orders made via the “Cash on Delivery” method, they will be charged for the product cost and applicable shipping/custom/courier charges if the product is returned. No refunds will be processed for damaged products.
6. The images of the products shown on the website are only for reference purposes. The product ordered by the user will be delivered in the current condition present. The user should know that there will be no refunds regarding this.
7. We do not provide any medical or emotional treatments. Also, we don’t take responsibility for the effects of the astrological products purchased by the user of their own will. No refunds will be issued in these cases.
8. There is no offer of a refund for any incorrect contact number in the “Call with Astrologer” service. The user is responsible for it and should keep their number in coverage and answer the calls. It is also the same for connected calls.
9. The “Call with Astrologer” feature does not offer refunds for incorrect contact numbers. Users should keep their contact number in full coverage and answer calls when received, and no refunds will be issued for connected calls.
10. Refunds will be processed after deducting transaction charges, shipping and courier costs, customs duty, and any other charges incurred by the Website during processing and delivery of the product, as applicable, and any applicable fees.
11. If the Website or Payment gateway’s webpage experiences server issues like slowdown, failure, or session timeout, users should check if their Bank Account has been debited before initiating a second payment. If debited, avoid making the payment twice and contact the Website for confirmation. If not debited, users can initiate a fresh transaction.
12. The website will refund the full cost of one order, even after preventing multiple payments on the same order, without deducting transaction charges.
13. The Website reserves the right to refuse or cancel orders due to non-acceptance, inaccuracy, pricing errors, or other issues. If a user’s order is cancelled after charges have been paid, the booking amount will be refunded. This policy applies to all situations involving service availability, pricing errors, and other identified problems.

USER OBLIGATION

1. The User is responsible for not violating the privacy policy, terms and conditions, and other terms on the Website. They must not post false, misleading, defamatory, harmful, threatening, abusive, harassing, offensive, racist, hatred, infringing rights, violating laws or regulations, uploading or posting content that they do not have the right to make available, infringing on patents, trademarks, trade secrets, copyrights, or proprietary rights. They must not collect screen names or email addresses for advertisement, send unsolicited emails, upload viruses or corrupted files, interfere with access to the Website, attempt to gain unauthorized access, violate applicable laws or regulations, and use the Services for personal use only.
2. They must not resell or make commercial use of the Services without written consent from the Website. 2. The User can pay Website fees using debit/credit cards or online banking accounts. They must ensure accurate card/bank account details when initiating transactions and confirm their lawful entitlement to use such methods.
3. The User must ensure sufficient credit is available on their nominated card or bank account for payment of dues or selected bills, including applicable fees.
4. The User agrees that if any part of these Terms of Usage is deemed invalid or unenforceable, it will be replaced by a valid, enforceable provision, and the remaining terms will continue in effect.

DISCLAIMER / LIMITATION OF LIABILITY / WARRANTY

1. The user acknowledges that the Website does not offer warranties for its astrological counselling services, as it is based on individual knowledge and interpretations.
2. The website cannot guarantee the service will meet user requirements and be uninterrupted, secure, accurate, reliable, or error-free. Users must disclose their emotional, mental, and physical state to the astrologer for informed advice. Any software errors will be corrected.
3. The Website provides its services and materials on an “as is” basis without any warranty, including implied warranties of title, non-infringement, merchantability, or fitness for a particular purpose. The Website does not guarantee that the services will meet user requirements, provide uninterrupted, timely, secure, or error-free use, or that results will be effective, accurate, reliable, or that errors or defects will be corrected.
4. The Website disclaims liability for User content arising from intellectual property rights, libel, privacy, publicity, obscenity, or other laws, and for misuse, loss, modification, or unavailability.
5. Pracheen Astrology offers various services through our shop, including astrological content, reports, tarot readings, fortunes, numerology, predictions, live telephone consultations, and products. They charge per minute and cannot guarantee the reliability of astrological effects or products.
6. The Website is not liable for any inaccuracies, errors, delays, or omissions in data, information, or messages, nor for any loss or damage resulting from such inaccuracies. The Website and payment service providers, employees, directors, and third-party agents are not liable for any damages arising from the provision of services, unauthorized access, data transmission alteration, or service suspension or termination.

Our liability to you is limited to the amount paid for the service during your membership term, regardless of any cause or action.

INDEMNIFICATION

The User is responsible for indemnifying and defending the Website, its parent, subsidiaries, affiliates, officers, directors, employees, suppliers, consultants, and agents from third-party claims, liability, damages, and costs arising from their use of the Services, violation of Privacy Policy, or rights infringement.

PROPRIETARY RIGHTS TO CONTENT:
